These Terms of Service (“Terms”) govern your use of the websites, mobile games and related services (collectively, the “Services”) provided by Vertex Cored Tech LLC (“Vertex Cored Tech”, “we”, “us” or “our”). By downloading, accessing or using the Services, you agree to these Terms.

1. Acceptance of these Terms

If you do not agree to these Terms, please do not use the Services. If you are using the Services on behalf of an organisation, you represent that you have authority to accept these Terms on its behalf.

2. Licence to use our games

Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable and revocable licence to download and use our games for your own non-commercial entertainment. All use is also subject to the rules of the platform through which you obtain the game (the Apple App Store or Google Play).

3. Acceptable use

You agree not to:

• copy, modify, reverse-engineer, decompile or create derivative works from the Services, except as permitted by law;
• use cheats, bots, automation or exploits, or interfere with the normal operation of the Services;
• access the Services through unauthorised means or attempt to disrupt our systems or security;
• use the Services for any unlawful purpose or in violation of these Terms or applicable law.

4. Intellectual property

The Services, including all games, software, artwork, characters, audio, trademarks and other content, are owned by Vertex Cored Tech LLC or its licensors and are protected by intellectual-property laws. Except for the licence granted above, we reserve all rights.

5. Purchases and virtual items

Some games may offer optional in-app purchases or virtual items. These purchases are processed by the Apple App Store or Google Play under their terms. Virtual items have no monetary value, are licensed, not sold, and are non-refundable except where required by law or the applicable store’s policy.

6. Disclaimers

The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement, to the fullest extent permitted by law. We do not warrant that the Services will be uninterrupted, error-free or secure.

7. Limitation of liability

To the fullest extent permitted by law, Vertex Cored Tech LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of the Services. Our total liability for any claim relating to the Services will not exceed the amount you paid us, if any, in the twelve months before the claim.

8. Termination

We may suspend or terminate your access to the Services at any time if you breach these Terms or if we discontinue a game. You may stop using the Services at any time by uninstalling our games.

9. Governing law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-laws rules. Any dispute arising from these Terms or the Services will be subject to the exclusive jurisdiction of the courts located in the State of Wyoming, unless applicable law provides otherwise.

10. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the Services after an update means you accept the revised Terms.
